S.M.E. (hereinafter “CORREOS”), with its registered office at Calle del Conde de Peñalver, n.º 19, 28006 Madrid (Spain) and Tax Identification Number (NIF) A-83052407, makes available to those users (hereinafter, the “User”) who subscribe to the service offered by CORREOS under that trade name.

The content of the Terms and Conditions may be amended; therefore, the User’s acceptance shall be in respect of the General Terms and Conditions available at any given time and those published at www.elcaminoconcorreos.com at the time the User contracts the Services.
Acceptance of these General Terms and Conditions shall be deemed to have been given without reservation of any kind and shall apply to each and every one of them, as well as to any other legal documents which, where applicable, govern the use of the Services and supplement the provisions of these General Terms and Conditions. These General Terms and Conditions shall apply from the moment CORREOS accepts the Service(s).
CORREOS may provide the services either directly or through third parties. These General Terms and Conditions apply to any other company whose services we use for the collection, transport or delivery of your consignment.
If the User does not agree with any of these Terms and Conditions, they must refrain from accessing and using the Services.
1.- Description of the Service
1.1. Features.
Paq Mochila is a service provided by CORREOS for the transport of users’ luggage between accommodation at the various stages of the Camino de Santiago.
1.2. Scope.
This service will be provided along the Way of St James routes defined by CORREOS within Spain and Portugal.
For further information on these defined Way of St James routes, please visit www.elcaminoconcorreos.com
1.3. Dimensions and Weight.
For the Paq Mochila service, luggage must not exceed 15 kilograms in weight and must not exceed the maximum dimensions of 56 x 40 x 25 cm. Should the luggage exceed these dimensions, distance or weight limits, CORREOS reserves the right to refuse to carry it, with no entitlement to a refund of the amount paid.
1.4. Price and payment method.
For the Paq Mochila service, the unit price is calculated on the basis of the transport of a single piece of luggage weighing no more than 15 kg, for journeys between stages of 25 kilometres or less. If a stage exceeds this distance, the price of the Service will be proportional to the number of stages equivalent to this distance (if the User wishes to travel 50 km per day, the price will correspond to 2 stages; and if the User books the 60 km option, the price will correspond to 3 stages, rounded up to the nearest whole number). The maximum distance is 60 km per day.
The final price of the Service contracted, as shown on the website, includes any indirect taxes that may apply.
Payment must be made in advance and can be made by credit/debit card or PayPal.
Invoices will be issued in accordance with current invoicing regulations.
By accepting these General Terms and Conditions, the customer expressly agrees and consents to receiving their invoices in electronic format.

Bookings must be made no later than 8.00 pm (Europe/Madrid time zone, UTC/GMT + 01:00, which becomes UTC+2 in summer) on the day before the Service is to be provided. When booking, you must specify the collection and delivery locations for the luggage, as well as your name, email address and contact telephone number.
To book this Service, the User must be aged 18 or over.
You must enter the details specified on the booking form: collection location, delivery location, start date and number of pieces of luggage. Should the User fail to inform CORREOS in accordance with the terms and deadlines specified, this may result in CORREOS either not providing the Service or providing the Service as originally requested in the initial booking, without any refund being due for any amount that may have been paid, and shall entail the User waiving the right to claim a refund of the amount paid for the Service.
1.6.- Additional services.

Each booking will have a unique Booking Code; the User must download a label associated with this unique Booking Code from the link sent in the Booking Confirmation Email and attach it visibly to each piece of luggage.
CORREOS will collect and deliver the luggage to the accommodation(s) chosen by the User, unless refused by the accommodation provider. Therefore, by accepting these General Terms and Conditions, the User warrants that they have a booking or permission from the accommodation provider to arrange for the delivery/collection of the luggage. Should this not be the case, CORREOS will return the luggage to the point of origin, and there will be no entitlement to a refund of the delivery charge paid or to any other form of claim.
This Paq Mochila service does not entitle the user to a reserved place at the accommodation where the luggage is to be delivered, as CORREOS has no involvement whatsoever in the relationship between the accommodation providers and the Users.
1.8.- Delivery method.
This Service includes the collection and delivery of luggage at the accommodation(s) and other locations chosen by the User, unless the accommodation provider refuses to accept them. - Luggage/baggage whose shape and contents pose a risk of causing harm to people or property.
3.2. CORREOS reserves the right to refuse any luggage/baggage that is in poor condition or shows signs of damage; to this end, it may ask the User to provide a written statement exempting CORREOS from any liability in relation to the poor condition and/or damage to the contents, provided that this does not affect the facility itself or other luggage/baggage.
4.- UNCLAIMED LUGGAGE/BAGGAGE
4.1. For the first thirty (30) days from the collection date agreed by the User, the luggage/baggage will remain at the CORREOS Main Office in Santiago de Compostela. Luggage/baggage left behind during this period will be returned in person at the Office, subject to the Customer paying the storage costs; the current rates applicable for each day will also be applied, depending on the period to which the charge relates, along with any other associated costs. CORREOS will send the forgotten luggage/baggage to the User, at its discretion, if the User so requests and pays all delivery costs in advance by postal order. The User undertakes to comply with these Terms and Conditions, as well as to act in accordance with applicable legislation, morality, good practice and the requirements of good faith and public order, exercising due diligence, and refraining from using the Luggage Storage Service in any way that may prevent, damage or impair its normal operation, the property or rights of CORREOS, other users or, in general, any third party.
6.2. Specifically, and without this imposing any restriction on the preceding paragraph, the Customer:
The User accepts responsibility for the consequences of any incorrect, incomplete, false or fraudulent declaration regarding the luggage/baggage or its contents, thereby exempting CORREOS from any liability.
- Declares that the luggage/baggage meets the requirements regarding dimensions, weight, packaging and contents to be accepted by CORREOS. In particular, the User undertakes not to use the Luggage Storage Service for illegal or unauthorised purposes and agrees not to store items whose mere possession or trade is illegal or requires a specific licence or authorisation.
- The Customer also undertakes not to use the Luggage Storage Service to store items intended for collection by a third party.
6.3. Any failure by the User to fulfil their obligations shall result in the User being liable for any damages caused to CORREOS or to third parties.
7.- WAIVER AND SUSPENSION OF THE SERVICE. RIGHT OF WITHDRAWAL.
7.1. CORREOS reserves the right to suspend the Luggage Storage Service and to refuse to store the luggage/baggage in the event of the User’s failure to comply with the provisions of these Terms and Conditions and, in particular, with the provisions of clause 5.
In cases where CORREOS is entitled to suspend the storage for a reason covered by these Terms and Conditions, it shall inform the User accordingly, and the User shall not be entitled to a refund of the amount paid.
7.2. Given that the Luggage Storage Service covered by this contract is a service provision contract, the User acknowledges and accepts, and is hereby informed prior to accepting the Terms and Conditions, that the right of withdrawal is not applicable to this contract as set out in Article 103 a) of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Act for the Protection of Consumers and Users, once the execution has started. The User therefore acknowledges that, upon acceptance of these Terms and Conditions, they will have forfeited their right of withdrawal.
8.- LIABILITY.
8.1. CORREOS, in its capacity as a storage facility, shall only be liable to the User for any loss, damage or harm sustained by the luggage/baggage stored as a result of its wilful misconduct or negligence, in accordance with the rules governing commercial storage.
8.2. CORREOS shall not, under any circumstances, be liable for any money or other valuables contained within any luggage/baggage.
CORREOS shall not be liable for any damage or natural wear and tear to luggage/baggage entrusted to its direct care, provided such damage is not attributable to its fault or to causes related to their storage in the facility. CORREOS shall not be liable for damage or loss resulting from force majeure and/or natural events such as, for example, earthquakes, floods, etc.
CORREOS shall not be liable for any deterioration or damage caused to contents that have not been declared by the User at the time of storage.
8.3. The User undertakes to indemnify and hold CORREOS harmless against any loss or damage arising from the User’s breach of any of the obligations set out in these Terms and Conditions, in particular the provisions of clause 5.
9.- DATA PROTECTION
In compliance with the applicable regulations on the protection of personal data, personal data will be processed by the state-owned company Correos y Telégrafos S.A, S.M.E. 11.- SEVERABILITY OF CLAUSES
The unlawfulness, invalidity or ineffectiveness of any of the clauses in these Terms and Conditions shall not affect the validity of the remainder, provided that the rights and obligations of the parties arising from the Terms and Conditions are not materially affected. “Material” is understood to mean any situation which seriously prejudices the interests of either party, or which affects the very subject-matter of these Terms and Conditions. Such clauses shall be replaced or supplemented by others which, whilst complying with the law, fulfil the purpose of those replaced. The parties waive any claim for damages that might arise from this circumstance.
12.- APPLICABLE LAW AND JURISDICTION.
These Terms and Conditions are governed by Spanish law.
In respect of any disputes that may arise in relation to the Luggage Storage Service and these Terms and Conditions, the parties submit exclusively to the jurisdiction of the Spanish courts, specifically the Courts and Tribunals of the city of Madrid, unless otherwise required by law (in particular, the competent jurisdiction in the case of consumers).

This Service is only available via collection and delivery at a Correos office. This includes the collection and delivery of the product at the Correos offices specified by the User in the Service booking form completed via the website www.elcaminoconcorreos.com
The consignment will be delivered to the Correos office designated by the User, unless, due to circumstances beyond CORREOS’ control, delivery must be made to another Correos office agreed upon by both parties.
The recipient will be notified of the consignment’s arrival at that Correos office via text message and/or email and/or PUSH notification on the Correos mobile app, provided that the User has supplied their telephone number or email address for this purpose, or that they are registered on the Correos app, as applicable. The consignment will remain available for collection by the recipient at the chosen Correos office for fifteen (15) days from the date of notification. If the consignment has not been collected by the end of this period, it will be returned to the office of origin, where it will remain in storage for the stipulated period of three (3) months. Once this period has elapsed, the consignment will be deemed abandoned, and the provisions of section 6 regarding such consignments will apply.

Undelivered items will be returned to the sender within 24 hours of the return being recorded in CORREOS’ systems, in addition to the timeframes set out above.
For consignments destined for the Canary Islands, there will be an additional six (6) days’ delivery time, and for those destined for Ceuta and Melilla, there will be an additional forty-eight (48) hours added to the initial delivery time. The User can check the status of their consignment via the Correos website (www.correos.es), via the app or by calling 915 197 197. Such information shall include the date and timestamp of the consignment status: accepted, delivery attempted, delivered, and returned, indicating, where applicable, the reasons for return or non delivery and the measures taken.
Any dispute arising from the provision of the Services may be raised in accordance with the procedures in place at CORREOS and as provided for in current legislation. Users may obtain information on these procedures at CORREOS branches, via the link www.correos.es/es/es/atencion-al-cliente, by email at mycorreos@correos.com, by telephone on 915197197 or 900 400 004 or by postal mail at the following address:
Sociedad Estatal Correos y Telégrafos S.A., S.M.E. --C/ del Conde de Peñalver, 19 Bis -- 28006 – Madrid, Spain.
3.- Use of the mobile text messaging service (SMS), telephone calls, emails and PUSH notifications
For the purposes of managing the delivery process, provided that the User has supplied the recipient’s telephone number and/or email address (for the purpose of sending emails) for this purpose, CORREOS will use this information to contact the recipient and manage the delivery, for example, to inform them of the approximate delivery date and time or to deal with any issues relating to the delivery (such as, for example, delivery delays). In the event that the recipient is registered on the CORREOS app and has given their consent to receive PUSH notifications, information regarding the approximate delivery date and time, for the purposes of managing the delivery and dealing with any issues relating thereto, will be sent via this channel.
The obligation to communicate by SMS, email, telephone and/or PUSH notifications assumed by CORREOS shall be effective from 9:00 to 21:00 from Monday to Friday and from 9:00 to 14:00 on Saturdays.
The Customer expressly recognises that SMS, emails and/or PUSH notifications sent by CORREOS within the agreed parameters (times and days) does not guarantee that such communications will be received by addressees within these timeframes, as under no circumstances shall CORREOS be held responsible for non-reception for reasons not attributable to CORREOS.
The customer also expressly declares and guarantees that the recipient is aware of and accepts the possibility that communication by SMS and/or email and/or PUSH notifications may arrive outside the agreed times and days, for reasons beyond the control of CORREOS. The customer exonerates CORREOS from any responsibility directly or indirectly derived from the moment in which such messages are received.
4.- Sender’s obligations
The sender shall comply with the applicable regulations in force regarding goods that are restricted or prohibited from being transported by CORREOS. The sender shall be liable for any consequences arising from an incorrect, incomplete, false or fraudulent declaration concerning the consignment or any part thereof, and shall hold CORREOS harmless from any liability. CORREOS notes that in legally established cases the relevant authorities can open and inspect a shipment without the sender’s prior notification.
The consignment meets the requirements regarding dimensions, weight and packaging necessary for its safe transit. CORREOS will not accept open, unpackaged or inadequately protected items, or those whose shape or contents pose a risk of causing harm to people or property.
The sender undertakes to use the specific packaging included in the Rate and described in section 1. The sender also undertakes to use the two types of packaging made available by CORREOS.
5.- Refusal and suspension of carriage
CORREOS reserves the right to waive the carriage of the goods or suspend carriage if it has already begun, in cases of non-compliance on the part of the Customer or Recipient of the provisions set out in these Terms and Conditions and,
in particular, of the provisions of section 7) concerning dangerous and prohibited goods.
In cases where CORREOS is entitled to suspend carriage for a reason covered by these General Terms and Conditions, it shall inform the User accordingly, and the User shall not be entitled to a refund of any carriage charges already paid. In cases of impediment to transport or delivery, CORREOS may either immediately unload the goods at the expense of whoever is entitled to them, taking charge of their safekeeping, or deliver the goods in deposit to a third party or to the competent judicial body or Transport Arbitration Board, which shall have the effect of delivery. In the event that CORREOS has chosen to unload the goods, it may consider the corresponding shipment abandoned if, three months after the date on which it first attempted to deliver them to the Recipient, it has not received any instructions in this respect from the person who has the power of disposal over them. In this event, it may proceed will the disposal of the goods, putting up the product for sale to cover the costs of transport and storage generated up until then. In the event that the market value of the goods, understood as the amount that would be obtained for a used item if it were put up for sale, is negligible, it may destroy them and claim against the Customer the total amount owed for carriage and storage. For all of the above, CORREOS may open and inspect the packages whose transport they have been entrusted with. In such cases, CORREOS shall be held harmless against any claims made by third parties claiming rights over the goods.
6.- Liability, claims and compensation
The transport service shall be governed by the provisions of Act 15/2009, of 11 November, on the Contract for the Land Transport of Goods (LCTTM, by its Spanish acronym), the Land Transport Organisation Act (LOTT), its regulations and implementing rules, and any other legal provisions in force at any given time.
Consequently, with regard to CORREOS’ liability, rights to make claims and the payment of compensation, the regulations set out above shall apply, as well as any relevant international conventions. The responsibility of Correos is strictly limited to direct loss, excluding all other types of loss or damage (such as, but not limited to, loss of profits, loss of interest and future business, etc.)
In accordance with the provisions of the LCTTM, compensation for loss or damage shall not exceed one third of the IPREM per day for each kilogram of gross weight of lost or damaged goods, whilst compensation for losses arising from delay shall not exceed the cost of carriage. The Recipient must state their reservations in writing, describing in general terms the loss or damage at the time of delivery. In the event of non-evident damages or losses, the reservations must be written within the seven calendar days after delivery. Compensation for a delay shall only be payable where written complaints have been submitted to CORREOS within twenty-one days from the day following the delivery of the goods to the Recipient. Where no reservations are made, it shall be presumed, unless proven otherwise, that the goods were delivered in good condition.
The User may extend the insurance coverage included in the online Paq Bicicleta service, up to a limit of €6,000 per consignment. For the purposes of this coverage and as a supplement to the carriage charge, the User shall pay the percentage indicated in the rates on the declared value, which must always be paid at the time of purchase via the Digital Channel.
In the event of a claim, and for the purposes of the documentary processing before the Insurance Company, the invoice justifying the amount of the damaged property shall be provided in the claim documentation, regardless of the declared value
Claims are limited to one per Consignment, and their liquidation is considered final for all related losses and damages. It shall be a prerequisite for claiming compensation for loss that the corresponding expenses for transport, insurance and others have been duly paid to CORREOS. Correos reserves the right to recover the consignment to inspect and value it, so the sender or recipient should have the damaged good available until the claim has been resolved.
The User, on receiving compensation, may request to be notified if the goods reappear within one year. In such a case, CORREOS shall proceed to deliver the goods upon restitution of the compensation received, minus any compensable expenses and without prejudice in any case for compensation for delay. In the absence of a request for notice or instructions for delivery, or if the goods reappear one year after payment of the compensation, CORREOS shall be free to dispose of the goods.
Neither party shall be liable to the other for failure to perform or delay in performance of the obligations set out in these Terms and Conditions for reasons of force majeure and/or circumstances beyond the control of the relevant party. Such circumstances include, and are not limited to, natural disasters or acts of God, acts of terrorism, labour disputes or work stoppages; acts of war; epidemics, pandemics or outbreaks of communicable diseases; quarantines; national, regional or local emergencies; or any other cause, whether similar to the foregoing or otherwise, beyond the control of the relevant party.
7.- Disclaimers
The Customer expressly declares that the consignment is acceptable for transport and is not classified as a toxic substance, dangerous goods, or prohibited or restricted articles, according to current regulations in Spain.
Consequently, the User undertakes not to send prohibited items or dangerous goods via CORREOS. For these purposes, the items listed in the Universal Postal Service, Users’ Rights and Postal Market Act, its implementing regulations and the International Postal Conventions, the European Regulation on the Carriage of Dangerous Goods by Road (ADR), the prohibitions and restrictions of the International Air Transport Association (IATA), the International Civil Aviation Organisation (ICAO) and other applicable legislation, are classified as hazardous materials, dangerous goods, prohibited or restricted items.
The User therefore undertakes to indemnify and hold CORREOS harmless against any loss or damage arising from the sender’s failure to comply with the applicable regulations in force and from any breach of the following warranties and declarations: that the consignment is not classified as dangerous material, dangerous goods, a prohibited or restricted item; that the consignment is duly identified; that the consignment is correctly packaged to ensure its safe transport by road, with ordinary care and handling; and that all obligations and formalities established for the safe transport of dangerous goods have been complied with, such as, by way of example, those set out in the Universal Postal Service Act, its implementing regulations, the National Regulations on the Safe Transport of Dangerous Goods by Air and the Technical Implementation Instructions, the International Postal Conventions, and other applicable legislation.
CORREOS hereby informs that in the cases provided for by law the competent authorities may open and inspect a consignment without prior notification to the User. By accepting these General Terms and Conditions, the User agrees that their consignment may be detained, subjected to inspection or other additional measures.
Furthermore, the User undertakes to use packaging specifically suitable for this particular product and to be aware of the specific regulations and those set out above regarding the contents of their consignments.
The added value of declared-value insurance will cover compensation for any damage to or loss of the goods.
8.- Cancellation of the service
Given that the service covered by the contract is the transport of goods for which a specific date or period of execution is stipulated, the Sender is aware, and is so informed prior to accepting the terms and conditions, that the right of withdrawal is not applicable to this contract as set out in Article 103(l) of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Act for the Protection of Consumers and Users.
9.- Personal data
Correos will process your personal data for the following purposes:

10.- Applicable law and jurisdiction
These Terms and Conditions are governed by Spanish law.
In the event of any dispute, the parties agree to submit to the jurisdiction of the Spanish courts, specifically the Courts and Tribunals of the provincial capital where the User is domiciled.
